General

  1. Welcome to the website nomadic.co.il (the “Site”), owned and operated by the Company.

  2. These Terms of Use, together with the Privacy Policy and Cookies Policy (collectively, the “Terms”), govern every visit to and purchase through the Site.

  3. Using the Site constitutes your express consent to these Terms. If you do not agree, please refrain from using the Site.

  4. The Company may, at any time and without notice, suspend, halt, modify, or restrict any part of the Site. You will have no claim against the Company for any such change.

  5. These Terms address all genders equally; they are written in the feminine form for convenience only.

  6. Headings are for convenience and will not affect interpretation.

  7. The Site is for personal use only; no commercial use may be made of the Site or of products purchased through it.

  8. Computer records kept by the Company regarding actions on the Site shall constitute prima-facie evidence of those actions.

  9. All content is provided “as is.” You may not copy, modify, transmit, display, publish, sell, or distribute any part of the Site without the Company’s prior written consent.

  10. If there is any conflict between Site content and these Terms, these Terms shall prevail.

Products

  1. “Products” means any items offered for sale on the Site from time to time.

  2. The Company is under no obligation to maintain any particular assortment of Products and may change or discontinue Products at its sole discretion.

Eligibility to Purchase

  1. A user may purchase Products only if all the following apply:
    3.1. The user is at least 18 years old and legally competent to enter binding contracts.
    3.1. The user holds a valid credit card issued by a card company operating in Israel, or has the lawful consent of the cardholder to use that card.
    3.1. The user maintains an active e-mail address.

  2. The Company may refuse or cancel any order, or block access, if user conduct violates these Terms or disrupts regular Site operation.

  3. The Company reserves the right to limit the quantity of Products a user may order.

Placing Orders

  1. Orders may be placed by phone with a Company representative; these Terms apply equally.

  2. Orders may be placed on the Site as a guest by entering all requested details.

  3. Alternatively, users may register on the Site; registration requires choosing a password and allows order tracking in a personal area.

  4. After selecting Products and adding them to the “Cart,” follow the on-screen checkout instructions.

  5. Complete and accurate information and a payment method are required to finish the order.

  6. Payment methods include credit cards and PayPal (subject to PayPal’s terms). Charges are made only after authorization; if authorization fails, the Company will contact the user to complete the transaction.

  7. After checkout, an e-mail confirmation with the order number will be sent to the address provided.

  8. If the Company later discovers a Product is out of stock, it is not obligated to supply it; the user will not be charged for that Product and will have no claim against the Company.

  9. Prices may change at any time. The applicable price is that displayed at the moment the order is placed.

Delivery & Shipping

  1. Product prices exclude shipping fees; shipping is added at checkout per the Shipping Policy.

  2. After an order is approved, the Company (or its delivery partner) ships the Products to the Israeli address provided.

  3. Estimated delivery times in the Shipping Policy run from the approval date. Delays beyond the Company’s control create no liability.

  4. If delivery fails due to incorrect details or refusal to accept the parcel, shipping fees will be charged.

  5. The Company is not liable for delays caused by force majeure, war, strikes, natural disasters, security events, epidemics, lockdowns, or other events beyond its control.

  6. The Company may refuse delivery to areas with security restrictions.

  7. Shipping rates may change at any time; the rate in effect at checkout applies.

Order Cancellation (Consumer Protection Law, 1981)

  1. A user may cancel a purchase from the transaction date until 14 days after receiving the Products or the disclosure notice (whichever is later).

  2. Between 14 and 30 days after receipt, Products may be returned for store credit valid for at least two years.

  3. If the user is a person with a disability, a senior citizen, or a new immigrant (as defined by law) and the transaction involved a telephone conversation, cancellation is permitted up to 4 months after receipt (proof may be required).

  4. Cancellation requires sending the Company a notice including full name, ID number, e-mail, and order number.

  5. If Products were already received, they must be returned at the user’s expense: in person to the Company store, by COD mail, or via the Company’s courier (NIS 20).

  6. If cancellation is due to a defect, the Company will collect the Products at its expense.

  7. Individual items sold as part of a set may not be returned separately.

  8. Upon cancellation, the Company refunds the amount paid for the returned Products and cancels related charges.

  9. The Company may charge a cancellation fee of 5 % of the order value or NIS 100 (whichever is lower) unless the cancellation is due to a defect.

  10. Orders paid with a gift card are refunded as store credit.

  11. Refunds are issued to the original payment method.

  12. The Company may seek compensation if returned Products are diminished in value.

Product Exchanges

  1. Within 30 days of receipt, a Product may be exchanged or returned for store credit.

  2. Returns for exchange may be delivered in person to the store or collected by the Company’s courier (NIS 35). Products must be unused, intact, and in original packaging.

  3. If the exchange is due to a defect, the Company will collect the Products at its expense.

  4. Exchanges require presentation of the original invoice.

Company’s Right to Cancel

  1. The Company may cancel an order, including for pricing errors, at its sole discretion. The user will be notified and refunded any amounts paid.

Promotions & Discounts

  1. The Company may run promotions, discounts, and other offers and may modify or terminate them at any time.

  2. Eligibility for a promotion is re-calculated if order details change.

  3. Refunds for discounted items are based on the amount actually paid.

  4. For offers such as “buy one + one,” all items in the deal must be returned together.

  5. Where multiple items participate in one promotion, the discount applies to the lower-priced item(s).

Limitation of Liability

  1. The Company shall not be liable for any indirect, consequential, or special damages arising from use of the Site or purchase of Products, including lost income.

  2. Information on the Site may contain inaccuracies; the Company is not liable for such inaccuracies.

  3. Color tones and images are illustrative; actual Products may differ.

  4. If liability is found, the Company’s cumulative liability shall not exceed the price actually paid for the Product giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless the Company and its affiliates from any claim, loss, or expense resulting from your misuse of the Site or violation of these Terms.

Marketing Communications

  1. By providing contact details, you expressly consent to receive newsletters, offers, and advertising messages via e-mail, SMS, fax, or automated dialing in accordance with Israeli law. You may opt out at any time.

Site Suspension

  1. The Company may suspend or terminate Site operations, temporarily or permanently, at any time.

Intellectual Property

  1. All intellectual-property rights in the Site (including text, images, code, databases, and trademarks) belong exclusively to the Company. No use may be made without prior written consent.

  2. It is forbidden to copy, reproduce, distribute, sell, market, or translate any Site content without the Company’s prior written consent.

  3. No commercial use may be made of data published by the Company without express written permission.

Electronic Documents

  1. The Company may send invoices, receipts, and other documents electronically (e-mail, SMS, etc.). By using the Site you consent to receive such documents electronically.

Prohibited Uses

  1. You may not:
    • Use the Site for any unlawful or commercial purpose.
    • Collect personal data from other users.
    • Disrupt or overload Site infrastructure.
    • Bypass security measures.
    • Reverse-engineer, copy, or reproduce any part of the Site.
    • Violate any applicable law.

Breach of Terms

  1. If the Company suspects a breach, it may—without notice—block access, cancel orders, and/or seek legal remedies.

Site Content & User Content

  1. All Site information is provided “as is.” Opinions, articles, and reviews are non-binding. You must ensure any content you submit does not infringe rights, encourage unlawful behavior, or violate privacy. You grant the Company a perpetual, worldwide, royalty-free license to use any content you submit.

External Links

  1. The Site may contain links to third-party sites. The Company is not responsible for their content or security and shall not be liable for any damage arising from their use.

Governing Law & Jurisdiction

  1. These Terms are governed by the laws of the State of Israel. Exclusive jurisdiction lies with the competent courts of Tel-Aviv-Jaffa.

Miscellaneous

  1. If any provision is held invalid, the remaining provisions remain in force.

  2. Prices include VAT where applicable.

  3. No waiver by the Company constitutes a waiver of any other rights.

  4. The Company may amend these Terms at any time; updated Terms posted on the Site are binding. Continued use of the Site after changes constitutes acceptance of the revised Terms.
